    Family on rent strike in Westlake is evicted after not paying rent

    “We regret having to take this action, but the tenant in this unit failed to pay rent for seven months”

    A family of five participating in the Burlington Unidos rent strike in Westlake was evicted Wednesday after a jury ruled they violated their lease by refusing to pay rent.

    Landlord Donald Crasnick and building owner Lisa Ehrlich filed a petition in Los Angeles Superior Court in March asking for an order to remove the tenants after they refused to pay rent increases. The family stopped paying rent, because they say they were living in substandard conditions.

    Proposed rule would define rent control tenants as “human beings” to oust corporations

    Any landlord leasing a rent-controlled apartment to a corporation without first getting a removal permit from the Rent Control Board is running afoul of the law, according to the Board’s top lawyer, J. Stephen Lewis. The assertion comes as the Board attempts to clarify its own rules in order to deter the practice in Santa Monica.

    The issue came to light in June after a rent-controlled building at 1238 and 1242 Tenth Street began advertising apartments on corporate rental websites. A leasing agreement obtained by the Daily Press included a “corporate application for rental form” and an addendum to rent “by the suite.” At the time, the Board’s Executive Director said the addendum sounded problematic but there was nothing illegal about leasing a rent-controlled apartment to a corporation.

    On Wednesday, Lewis sought to clarify rules for all landlords who may have corporate tenants.

    August 8, 2018 -- Term limits would either bring new perspectives to a City Council whose members often serve "virtually lifelong" terms or pave the way for "novice" elected officials beholden to the City bureaucracy.

    Those are the key arguments that will try to persuade Santa Monica voters to support or oppose a term limits initiatives that will appear on the November 6 ballot.

    The measure -- which would limit Council members to three terms -- would take effect on, or after, the election ("Santa Monica Council Grudgingly Places Term Limits Measure on Ballot," July 30, 2018).

    Real estate investors and other opponents of a ballot measure that would allow California cities to expand rent control have raised more than $21 million since the beginning of the year—far outpacing supporters.

    But a massive donation from the measure’s primary backer, the Los Angeles-based AIDS Healthcare Foundation, could help even the score.

    Last week, AHF, which has poured tens of millions of dollars into campaign financing for ballot initiatives in recent years, announced that it would contribute $10 million to the campaign to support the measure. That nearly quintuples the $2.5 million raised by supporters to this point.

    Amid a tense battle over rent control in California, real-estate interests are writing big checks to defeat a November ballot measure that would give cities more power to regulate what landlords can charge tenants — and the initiative’s backer responded this week with a $10 million cash infusion.

    “We know we will be significantly outspent by the opposition, backed by deep-pocketed developers and investors who continue to wreak havoc in the housing markets,” AIDS Healthcare Foundation President Michael Weinstein wrote in a news release Tuesday.

    With the Santa Monica school year about to begin this month, local parents, educators and landlords should be aware of the unique problems caused by evictions during the school year as well as a new city law that limits such evictions.

    To protect families in the future, the Santa Monica City Council passed an ordinance in May 2018 that enhances tenant protections for students and educators against no-fault evictions during the school year. Under the law, a court should not grant an eviction if the following are true:

    1)      a child under the age of 18 or any educator resides in the unit; and

    2)      the child or educator is a tenant in the unit or has a custodial or family relationship with a tenant in the unit; and

    3)      the tenant has resided in the unit for 12 months or more; and

    4)      the effective date of the notice of termination of tenancy falls during the child or educator’s school year; and

    5)     the termination does not allege any fault of the tenant but is based on the owner’s intent to occupy, demolish or withdraw the unit from the rental market.

    (Too early! some said) I started writing in earnest about the upcoming election in November for City Council seats. Meaning, since there was no Earnest currently on the Council, I couldn’t recommend any incumbent and had to go scour the mean streets of Santa Monica for prospects.

    Which raises a good question: do you have to have a Santa Monica address to run for Council? I would think so. But can we in good conscience deny representative rights and privileges to folks who have resided here for years, or decades, just because they don’t lay title to a street address? Are you your home? If you are homeless, are you nothing? And with their numbers, don’t the homeless deserve to have their own seat on the Council? At least one. They could be their own district. Imagine the campaigning. I might start going to Council meetings again.

    Here in Santa Monica, we saw a 4% increase in homelessness in 2018, which shows a significant decline in growth from last year’s 26% increase. We are confident that we will continue to see a difference, especially with the launching of the Council’s approval of a one-time investment of $1.4M.

    August 7, 2018 -- Two slow-growth council hopefuls who had been intent on mounting a stiff challenge against Santa Monica incumbents have decided not to enter the race for three open seats.

    Citing the uncertainty surrounding a voting rights lawsuit that could impact the November 6 election, Armen Melkonians said he and his running mate Kate Bransfield will not submit the nominating petitions they pulled last month.
